French Public Health CodeIn force

Updated 6 Nov 2023

I. - Professionals working in health centres are salaried employees. When the health centres are managed by the territorial authorities or their groupings mentioned in article L. 6323-1-3, these professionals may be employees of these authorities or their groupings. Where the health centres are managed by a non-profit organisation in the form of a public interest grouping of which at least two local authorities or groups of local authorities are members, these professionals may be employees of this public interest grouping.

Health centres may benefit from the participation of volunteers in their activities.

II. - In centres with dental or ophthalmological activities, for these activities only, when the centre employs more than one medical professional in this capacity, a dental committee or a medical committee is set up. It brings together all the medical professionals working in the centre for these activities, excluding the legal representative of the managing body. Together with the manager, it is responsible for the policy of continuous improvement in the quality, appropriateness and safety of care, as well as for the ongoing training of the healthcare professionals working in the centre in respect of these activities. Representatives of the centre's nursing staff and users are invited to sit on this committee. Their participation is required at least once a year.

The committee meets at least once every three months. Minutes of its meetings are taken and sent without delay to the health centre manager and to the Director General of the Regional Health Agency. The committee appoints a chairman from among its members, who holds this position for a renewable period of one year. The tasks and operating procedures of the Dental Committee and the Medical Committee are specified by decree.

III. - The manager of a health centre shall prominently display, on the premises of this centre and its branches, as well as on its website and on the digital communication platforms used for this centre, the identity and functions of all the doctors and dental surgeons practising there, including on a part-time or replacement basis. The patient must be able to identify the doctor or dental surgeon carrying out the consultation or treatment as soon as the appointment is made. The manager must ensure that the establishment's internal regulations provide for the wearing of a name badge indicating the function of the healthcare professional.

IV. - In health centres and their branches with ophthalmological activity, the number of medical assistants may not exceed the number of doctors.

Common Questions

Working with a corporate lawyer in France — Q&A

Any time a strategic decision changes how the company is owned, governed or contractually bound — incorporation, fundraising, M&A, restructuring, shareholder agreements, or major commercial contracts. Earlier engagement always costs less than later remediation.

A notary (notaire) is a public officer who authenticates specific deeds (mainly real-estate transfers and certain family-law acts). A corporate lawyer (avocat) advises on strategy, negotiates and drafts company documents, and represents you in disputes. The two roles complement rather than overlap.

Yes — most of our clients are foreign suppliers, investors or holding entities. We bridge the gap between French law and your home jurisdiction's expectations and deliver everything bilingually.

The SAS (Société par Actions Simplifiée) is the default choice for most international structures: flexible governance, single shareholder allowed, no minimum capital, and works cleanly with foreign holding entities. We assess SARL, SA, SCI on the merits when the situation calls for it.

Yes — communications with a French avocat are protected by the secret professionnel (Article 66-5 of the Law of 31 December 1971). This protection is broader than the common-law attorney-client privilege and applies to written and oral exchanges.

We work on fixed fees for clearly scoped engagements (incorporation, contract drafting, audits) and on monthly retainers for ongoing advisory. Hourly billing is the exception, not the default. You always know the cost before work starts.

Typical timeline is 2–3 weeks from KYC kick-off to RCS registration, assuming standard documentation. Holding-company structures, foreign-shareholder identification or in-kind contributions can extend this — we flag the gating items at the first meeting.

Absolutely. We routinely coordinate with your in-house counsel, expert-comptable or notaire — pragmatic collaboration is the norm, not the exception. We send them everything they need to do their part without duplicating work.
