French Public Health CodeIn force

Updated 4 Nov 2023

I.-The services of the professionals referred to in article L. 2135-1 are included in the assessment and early intervention pathway when they have signed a contract with a structure designated in accordance with the procedures laid down in the same article.

II - The healthcare professionals mentioned in article L. 162-5 and the medical auxiliaries mentioned in article L. 162-9 of the Social Security Code may take part in the pathway under the conditions and according to the terms of reimbursement set out in the agreements referred to in these articles.

III - For the healthcare professionals mentioned in articles L. 4331-1 and L. 4332-1 of this Code and psychologists, the pathway may include the following services:

1° For occupational therapists: an assessment to determine the needs of children in carrying out activities of daily living in relation to their sensory-motor, sensory and cognitive development and, if necessary, interventions to meet the needs thus identified and to act on the children's environment;

2° For psychomotricians: a psychomotor assessment including, in particular, an examination of sensory-motor and neuromotor development, and, if necessary, interventions relating to the disturbances observed;

3° For psychologists: on the one hand, a qualitative and quantitative assessment of the child's developmental skills and, if necessary, additional neuropsychological tests targeting specific areas of cognitive and socio-communicational development; on the other hand, for psychologists who have specific expertise defined by order of the ministers responsible for health and social security, early intervention in conjunction with all available functional assessments.

Interventions may be interrupted by a doctor from the designated structure after discussion with the liberal professionals, at the request of the family, in the event of early admission to a suitable structure or when the interventions are no longer necessary.

IV - The professionals mentioned in III are paid by the designated structure for a sequence of services, in the form of a lump sum. They may not request direct payment from patients.

V.-As an exception to article R. 314-122 of the Code de l'Action Sociale et des Familles, reimbursement of additional care is not subject to the prior agreement of the medical control department for the duration of the assessment and early intervention programme.

Common Questions

Working with a corporate lawyer in France — Q&A

Any time a strategic decision changes how the company is owned, governed or contractually bound — incorporation, fundraising, M&A, restructuring, shareholder agreements, or major commercial contracts. Earlier engagement always costs less than later remediation.

A notary (notaire) is a public officer who authenticates specific deeds (mainly real-estate transfers and certain family-law acts). A corporate lawyer (avocat) advises on strategy, negotiates and drafts company documents, and represents you in disputes. The two roles complement rather than overlap.

Yes — most of our clients are foreign suppliers, investors or holding entities. We bridge the gap between French law and your home jurisdiction's expectations and deliver everything bilingually.

The SAS (Société par Actions Simplifiée) is the default choice for most international structures: flexible governance, single shareholder allowed, no minimum capital, and works cleanly with foreign holding entities. We assess SARL, SA, SCI on the merits when the situation calls for it.

Yes — communications with a French avocat are protected by the secret professionnel (Article 66-5 of the Law of 31 December 1971). This protection is broader than the common-law attorney-client privilege and applies to written and oral exchanges.

We work on fixed fees for clearly scoped engagements (incorporation, contract drafting, audits) and on monthly retainers for ongoing advisory. Hourly billing is the exception, not the default. You always know the cost before work starts.

Typical timeline is 2–3 weeks from KYC kick-off to RCS registration, assuming standard documentation. Holding-company structures, foreign-shareholder identification or in-kind contributions can extend this — we flag the gating items at the first meeting.

Absolutely. We routinely coordinate with your in-house counsel, expert-comptable or notaire — pragmatic collaboration is the norm, not the exception. We send them everything they need to do their part without duplicating work.
