The Chairman of the Assistance publique-hôpitaux de Paris Institutional Medical Committee may delegate all or some of the following powers to the Chairman of the local Institutional Medical Committee of a group of hospitals or a hospital, for the purposes of examining matters relating to that group or hospital and in accordance with the procedures laid down by the Assistance publique-hôpitaux de Paris internal rules:

A.-Power to propose, jointly with the head of the division or the head of the department, functional unit or any other internal structure, the recruitment of a contractual practitioner, as provided for in article R. 6152-411 ;

B.-Examination, at his request, of the individual situation of an intern, as provided for in article R. 6153-2-4 ;

C.-Competence to be informed about the table of leaves of attached practitioners, as provided for in article R. 6152-613 ;

D.-Issuing its assent to the reinstatement of a hospital practitioner in his post after secondment, as provided for in article R. 6152-59;

E.-Issuing the following opinions:

1° Opinion prior to the termination, in the interests of the service, of the duties of a person in charge of an internal structure, department or functional unit, as provided for in article R. 6146-5 ;

2° Opinion on the agreement allowing a hospital practitioner to work in several establishments, provided for in article R. 6152-4;

3° (Repealed) ;

4° Opinion prior to referral to the Medical Committee by the Director General, as provided for in Article R. 6152-36 ;

5° Opinion prior to a hospital practitioner being placed on temporary assignment, as provided for in Article R. 6152-48;

6° Avis sur la mise à disposition d'un praticien hospitalier, prévu à l'article R. 6152-50 ;

7° Opinion on the request for placement in search of an assignment, as provided for in the second and third paragraphs of article R. 6152-50-1 ;

8° Opinion on the assignment of a hospital practitioner seeking an assignment, as provided for in article R. 6152-50-5;

9° Opinion on the secondment of a hospital practitioner and its first renewal, as provided for in Article R. 6152-52;

10° Opinion on the compulsory secondment of a hospital practitioner, as provided for in Article R. 6152-54;

11° Avis sur le placement en disponibilité d'un praticien hospitalier et son premier renouvellement, prévu à l'article R. 6152-65 ;

12° to 19° (Repealed) ;

20° Avis sur la prolongation d'activité d'un praticien hospitalier, prévu à l'article R. 6152-329 ;

21° Avis sur le non-renouvellement d'une prolongation d'activité prévu à l'article R. 6152-332 ;

22° Avis sur la convention permettant à un praticien contractuel d'exercer son activité dans plusieurs établissements, prévu à l'article R. 6152-404 ;

23° Avis sur la convention d'engagement de carrière hospitalière conclue avec un praticien contractuel, prévu à l'article R. 6152-404-1 ;

24° Opinion on the termination of a contractual practitioner's contract in the event of serious misconduct or professional inadequacy, in the absence of an opinion from the hospital medical committee within two months of its convening, as provided for in article R. 6152-413 ;

25° Opinion on the dismissal of a contractual practitioner with an open-ended contract, in the absence of an opinion from the establishment's medical commission within two months of its convening, as provided for in article R. 6152-413-1 ;

26° Opinion on the suspension of a contractual practitioner, as provided for in article R. 6152-414 ;

27° Avis sur la prolongation d'activité d'un praticien contractuel, prévu à l'article R. 6152-424 ;

28° Avis sur la convention permettant à un assistant des hôpitaux d'exercer son activité dans plusieurs établissements, prévu à l'article R. 6152-501 ;

29° Avis sur la mise à disposition d'un assistant des hôpitaux, prévu à l'article R. 6152-502 ;

30° Avis sur la décision de suspendre la participation d'un assistant des hôpitaux à la continuité des soins ou à la permanence pharmaceutique, prévu à l'article R. 6152-505 ;

31° Avis sur le recrutement d'un assistant des hôpitaux prévu à l'article R. 6152-510 ;

32° Opinion on the penalty that may be imposed on a hospital assistant, in the absence of an opinion from the establishment's medical commission within two months of his being convened, as provided for in article R. 6152-530;

33° Avis sur la résiliation du contrat d'un assistant des hôpitaux en cas d'insuffisance professionnelle, en l'absence d'avis de la commission médicale d'établissement dans les deux mois de sa convocation, prévu à l'article R. 6152-532 ;

34° Opinion on the agreement allowing an attached practitioner to work in several establishments, as provided for in article R. 6152-604;

35° Avis sur la décision de suspendre la participation d'un praticien attaché à la continuité des soins ou à la permanence pharmaceutique, prévu à l'article R. 6152-607 ;

36° Opinion on the recruitment of an associate practitioner, as provided for in article R. 6152-609;

37° Opinion on the modification of the work quota, structure or place of assignment of an attached practitioner, as provided for in article R. 6152-610;

38° Avis sur le congé non rémunéré pouvant être accordé à un praticien attaché, prévu à l'article R. 6152-615 ;

39° Opinion on the sanction that may be imposed on an associate practitioner, in the absence of an opinion from the establishment's medical committee within two months of his being convened, as provided for in article R. 6152-626 ;

40° Opinion on the suspension of an associate practitioner who is the subject of a disciplinary procedure or a procedure for professional incompetence, as provided for in article R. 6152-627 ;

41° Opinion on the measure taken in respect of an associate practitioner in the event of professional incompetence, in the absence of an opinion from the establishment's medical committee within two months of his being convened, as provided for in article R. 6152-628 ;

42° Avis sur la résiliation du contrat d'un praticien recruté sur le fondement de la section 7 du chapitre II du titre V du livre Ier de la sixième partie du présent code, prévu à l'article R. 6152-711 ;

43° Opinion on the referral of an intern's situation to the medical committee, as provided for in article R. 6153-19.

In addition, the chairmen of the local medical establishment committees may exercise, by delegation from the chairman of the medical establishment committee, for the hospital groups and hospitals concerned, the powers conferred on the latter by article R. 6146-4. However, in the event of a negative opinion from the head of the department on the proposal from the chairman of the local medical commission for the appointment of a head of department, the proposal for appointment is made by the chairman of the local medical commission.

The chairmen of the local medical establishment committees may also exercise, by delegation from the chairman of the medical establishment committee, for the hospital groupings and hospitals concerned, the powers conferred on the latter by article R. 6152-13. However, when he intends to issue an unfavourable opinion on an appointment to a permanent practitioner post, the chairman of the local hospital medical board refers the matter to the chairman of the hospital medical board, who issues the opinion provided for by these provisions.

The chairmen of the local hospital medical boards report to the chairman of the hospital medical board and to the Director General on the results of the actions and the summary of the results relating to the implementation of the powers they have exercised in application of this article.
