Single chapter

Subject to the adaptations provided for by Article R. 811-3 below, the following shall apply in the Wallis and Futuna Islands:

1° Les dispositions du livre Ier à l'exception des articles R. 133-1, R. 133-2 (4°) et R. 135-1 à R. 135-4;

L'article R. 136-1 est applicable dans sa rédaction résultant du décret n° 2021-1369 du 20 octobre 2021;

L'articles R. 122-3, R. 122-6, R. 122-7, R. 122-8, R. 122-10, R. 122-11, R. 122-12, R. 122-23 to R. 122-32, R. 134-3 to R. 134-9, R. 137-1 and R. 138-1 are applicable in their wording resulting from Decree no. 2022-928 of 23 June 2022.

2° The provisions of Book II in their wording, resulting from decree no. 2017-338 of 15 March 2017;

Articles R. 211-2 and R. 211-3 are applicable in their wording resulting from decree no. 2022-928 of 23 June 2022.

3° The provisions of Book III with the exception of Articles R. 326-1 to R. 326-7;

Articles R. 331-88, R. 332-1 and R. 343-2 are applicable in the wording resulting from Decree no. 2018-1126 of 11 December 2018;

The provisions of Title I bis are applicable in the wording resulting from Decree no. 2021-539 of 29 April 2021;

Articles R. 323-1, R. 323-5, R. 324-1, R. 331-56, R. 331-59, R. 331-60, R. 331-62 and R. 331-74-1 shall apply in the wording resulting from Decree no. 2021-1369 of 20 October 2021;

Articles R. 331-2 to R. 331-53 are applicable in their wording resulting from Decree no. 2021-1853 of 27 December 2021;

Articles R. 321-4-1, R. 321-29, R. 328-1 to R. 328-8, R. 329-13 to R. 329-20, R. 341-2 and R. 341-3 are applicable in their wording resulting from Decree no. 2022-928 23 June 2022.

4° The provisions of Book IV mentioned in the left-hand column of the table below, in the wording indicated in the right-hand column of the same table:

5° The provisions of Book V with the exception of Article R. 522-1 and Articles R. 512-2, R. 512-3, R. 512-13, R. 512-15, R. 513-1 and R. 513-2 only insofar as they concern industrial property attorneys;

Articles R. 521-2 and R. 521-5 are applicable in their wording resulting from Decree no. 2018-1126 of 11 December 2018;

6° The provisions of Book VI with the exception of Articles R. 612-2, R. 612-38, R. 613-25-1 to R. 613-25-4, R. 613-44, R. 613-44-1, R. 613-46, R. 613-56 and R. 613-58 only insofar as they concern industrial property attorneys under the following conditions:

However, Article R. 613-63 reads as follows:

"Art. R. 613-63 -A request for a reduction in the royalties provided for in Article L. 612-20, as it read prior to Law 2005-842 of 26 July 2005, shall be submitted in writing to the Director General of the National Institute of Industrial Property. It must be accompanied by a notice of non-taxation or equivalent justification. A reasoned decision is taken. The decision is notified to the applicant. If the application is granted, the benefit of the reduction is acquired by the applicant subject to the applicant producing each year a notice of non-taxation or equivalent justification";

Articles R. 623-51 and R. 623-53-1 are applicable as they appear in Decree no. 2019-966 of 18 September 2019.

Articles R. 623-6 and R. 623-58 are applicable as they appear in Decree no. 2019-1316 of 9 December 2019.

Articles R. 623-43, R. 623-45 and R. 623-46 are applicable in their wording resulting from Decree no. 2020-15 of 8 January 2020.

7° The provisions of Title I of Book VII with the exception of articles R. 712-2, R. 712-3, R. 712-13, R. 712-14, R. 712-21, R. 714-4, R. 714-4-1, R. 714-6, R. 716-1 and R. 716-2 only insofar as they concern industrial property attorneys, under the following conditions:
a) The provisions of Title I mentioned in the left-hand column of the table below, in the wording indicated in the right-hand column of the same table:

Articles R. 722-2 and R. 722-5 are applicable in their wording resulting from Decree no. 2018-1126 of 11 December 2018 on the protection of business secrecy.
