It is hereby instituted a grant to support investment in the départements, allocated to the départements and territorial collectivities of Saint-Pierre-et-Miquelon, Saint-Martin and Saint-Barthélemy.


I.-This grant is allocated, in the form of subsidies, by the State representative in the region or collectivity governed by Article 73 of the Constitution, with a view to territorial cohesion. It is distributed in the form of regional envelopes and is made up of the sum of two fractions:


1° Up to 77% of the amount of the allocation after deduction of the quotas provided for in Ia, the first fraction is calculated as follows:


> a) Up to 40% of the amount of the allocation after deduction of the quotas provided for in Ia, the first fraction is calculated as follows a) 40% on the basis of the population of municipalities located in an urban unit with fewer than 50,000 inhabitants or not belonging to an urban unit;


> 35% on the basis of the population of municipalities located in an urban unit with fewer than 50,000 inhabitants or not belonging to an urban unit b) 35%, based on the length of road classified in the departmental public domain, the length of road located in mountain areas being multiplied by 2;


> c) 25%, based on the length of road classified in the departmental public domain, the length of road located in mountain areas being multiplied by 2;


d) 25%, based on the length of road classified in the departmental public domain, the length of road located in mountain areas being multiplied by 2 c) 25% based on the number of children aged between 11 and 15 living in the region's communes


. The amount of the budgets calculated in this way may not be less than €1,500,000 or more than €20,000,000.


For the application of this 1°:

the population of communes is that defined in article L. 2334-2;


-the number of children is that established at the time of the last census;


the urban units are those appearing on the list published by the Institut national de la statistique et des études économiques;


> -the length of road taken into account is that of the last census -the length of roadway taken into account is assessed as at 1 January of the penultimate year;


2° Up to 23% of the amount of the allocation after deduction of the shares provided for in Ia, the second fraction is made up of the sum, at regional level, of departmental shares. One share is calculated for each département, provided that its per capita tax potential is not more than twice the average per capita tax potential of all the départements and that its per square kilometre tax potential is not more than twice the average per square kilometre tax potential of all the départements. For each of these départements, the share calculated is equal to the product of:


a) the ratio between the average per capita tax potential of all the départements and their per capita tax potential, this ratio not exceeding 2;


> and b) And the ratio between the average tax potential per square kilometre of all the départements and their tax potential per square kilometre, which may not exceed 10;


Ia. Ia - For the collectivities of Saint-Martin, Saint-Pierre-et-Miquelon and Saint-Barthélemy, grants under this allocation are awarded by the State representative in these collectivities, with a view to territorial cohesion.


These collectivities receive a share of the total amount allocated to them. These local authorities each receive a share equal to the product of the total amount of the grant multiplied by the ratio, increased by 10%, between the population of each of these local authorities and the national population, with the total amount calculated in this way not being less than 95% of the amount allocated the previous year.

I ter.- The representative of the State in the French department of Ile-de-France is responsible for the allocation of the grant.Each year, the representative of the State in the department presents to the commission provided for in article L. 2334-37 the guidelines that the representative of the State in the region plans to implement with regard to the allocation for the current financial year.


I quater. Ic - The representative of the State in the region or in the local authority governed by Article 73 of the Constitution will send the members of the committee provided for in Article L. 2334-37 of this code, within one month of its decision, a list of the projects subsidised within the jurisdiction of their department or local authority governed by Article 73 of the Constitution. This list is communicated within the same timeframe to the members of Parliament elected in this department or community governed by the same article 73. The representative of the State in the department sends the members of the commission provided for in article L. 2334-37 of this code and the members of Parliament elected in this department a report on the endowment for each financial year. He presents this report to the committee provided for in the same article L. 2334-37.


II -Allocations from the allocation to support investment in the départements are entered in the investment section of the beneficiaries' budgets.

Grants must be notified during the first half of the calendar year for at least 80% of the appropriations allocated to the region for the current financial year. Before 31 July of the current financial year, the list of operations that have received a grant, the amount of the projects and the amount of the grant awarded by the State are published on the official website of the State in the region. If this list is amended or supplemented between this publication and the end of the financial year, a corrective or supplementary list will be published in the same way before 30 January of the following financial year.
