I.-The agreement setting up the regional hospital grouping is drawn up and then sent to the agency or, where appropriate, to the competent regional health agencies. The Director(s) General of the relevant regional health agency(ies) will assess the agreement's compliance with the regional health plans and may request any amendments necessary to ensure such compliance. They approve the agreement and any renewals or amendments. Where applicable, this approval constitutes confirmation and authorisation to change the location of the authorisations mentioned in article L. 6122-1.

II - The agreement establishing the regional hospital grouping defines :

1° A shared medical project for all the establishments that are party to the regional hospital grouping agreement and, where applicable, the army hospitals associated with the regional hospital grouping. This medical plan shall be sent to the regional health agency or agencies with territorial jurisdiction before the constituent agreement is signed;

2° Any delegation of activities, as referred to in II of Article L. 6132-3 ;

3° Any transfers of care activities or heavy equipment between establishments belonging to the consortium;

4° The organisation of activities and the allocation of medical and pharmaceutical posts, resulting from the shared medical project and which may be provided for by means of a rider, as well as the procedures for setting up joint medical teams and, where appropriate, inter-institutional clusters;

5° The grouping's organisational and operational arrangements, in particular :

a) The designation of the support establishment responsible for carrying out the delegated functions and activities on behalf of the other establishments involved in the grouping. This designation must be approved by two thirds of the supervisory boards of the institutions that are members of the grouping. Failing this, the support institution is designated by the director general of the regional health agency concerned, after consulting the territorial committee of local elected representatives provided for in article L. 6132-5 ;

b) The composition of the strategic committee responsible for giving its opinion on the implementation of the agreement and the shared medical project. In particular, it includes the hospital directors, the chairman of the grouping's medical commission, the chairmen of the hospital medical commissions and the chairmen of the nursing, rehabilitation and medico-technical care commissions of all the hospitals involved in the grouping and, where an army hospital is associated with the regional hospital grouping, staff occupying functions equivalent to those mentioned for the representatives of the hospitals involved in the regional hospital grouping. The strategic committee may set up a restricted bureau to which it delegates all or part of its powers. The director of the support institution is the chairman of the regional hospital grouping's strategic committee. The chair of the grouping's medical commission is vice-chair;

c) The procedures for coordination between the hospital medical committees for the development of the shared medical project and, where appropriate, the setting up of joint bodies;

d) The role of the territorial committee of local elected representatives, responsible for evaluating the actions implemented by the grouping to guarantee equal access to safe, high-quality care throughout the grouping's territory. In this capacity, it may make proposals and is informed of the action taken on them. It gives its opinion on the regional hospital grouping's strategy. In particular, it gives its opinion on the shared medical project, the shared care project and the partnership and association agreements between the regional hospital grouping and establishments that are not part of the grouping.

The agreement establishing the newly-formed regional hospital grouping is published by the regional health agency on its website when the grouping comes into effect.
