Article R114-15

French Sports CodeIn force

Updated 8 Nov 2023

I.-The director of the centre may impose a disciplinary sanction on any athlete or trainee who contravenes the rules governing the operation of the establishment set out in the centre's internal regulations.

Disciplinary sanctions are :

1° A warning ;

2° a reprimand

3° Exclusion for a fixed period, not exceeding one year;

4° permanent exclusion.

The sanction of exclusion for a fixed period may be suspended in whole or in part. The athlete or trainee is definitively exempted from serving the part of the sanction for which he has been suspended if, for a period of five years after the sanction was imposed, he has not been subject to any other sanction. The imposition of a new sanction during this same period shall entail the revocation of the suspended sanction unless, when imposing the new sanction, the disciplinary authority decides, after consulting the Disciplinary Board, to definitively exempt the athlete or trainee from serving the part of the sanction for which he was suspended.

When the Director is considering imposing a fixed-term or permanent exclusion sanction, he shall first consult the Athlete and Trainee Life Council sitting as a disciplinary panel.

If necessary, the Director may, as a precautionary measure, ban an athlete or trainee from the establishment pending consultation with the Disciplinary Council. If the athlete or trainee is a minor, he or she will be handed over to his or her family or to the person exercising parental authority or guardianship over him or her. This measure does not constitute a sanction.

II - When the Athlete and Trainee Life Council sits as a disciplinary body, its composition remains as set out in article R. 114-14 and it is subject to the rules governing quorum and the adoption of opinions or deliberations set out in that article. It is convened by the Director in accordance with the conditions laid down in the internal regulations. It shall hear the athlete or trainee against whom a sanction is being considered, assisted, if he is a minor, by his legal representative and, whatever his age, by one or more advisers of his choice.

Common Questions

Working with a corporate lawyer in France — Q&A

Any time a strategic decision changes how the company is owned, governed or contractually bound — incorporation, fundraising, M&A, restructuring, shareholder agreements, or major commercial contracts. Earlier engagement always costs less than later remediation.

A notary (notaire) is a public officer who authenticates specific deeds (mainly real-estate transfers and certain family-law acts). A corporate lawyer (avocat) advises on strategy, negotiates and drafts company documents, and represents you in disputes. The two roles complement rather than overlap.

Yes — most of our clients are foreign suppliers, investors or holding entities. We bridge the gap between French law and your home jurisdiction's expectations and deliver everything bilingually.

The SAS (Société par Actions Simplifiée) is the default choice for most international structures: flexible governance, single shareholder allowed, no minimum capital, and works cleanly with foreign holding entities. We assess SARL, SA, SCI on the merits when the situation calls for it.

Yes — communications with a French avocat are protected by the secret professionnel (Article 66-5 of the Law of 31 December 1971). This protection is broader than the common-law attorney-client privilege and applies to written and oral exchanges.

We work on fixed fees for clearly scoped engagements (incorporation, contract drafting, audits) and on monthly retainers for ongoing advisory. Hourly billing is the exception, not the default. You always know the cost before work starts.

Typical timeline is 2–3 weeks from KYC kick-off to RCS registration, assuming standard documentation. Holding-company structures, foreign-shareholder identification or in-kind contributions can extend this — we flag the gating items at the first meeting.

Absolutely. We routinely coordinate with your in-house counsel, expert-comptable or notaire — pragmatic collaboration is the norm, not the exception. We send them everything they need to do their part without duplicating work.
