The parties may have recourse to arbitration for the settlement of disputes relating to the performance of the partnership contracts, with French law applying.
Without prejudice to the provisions of article L. 6 and special legislative provisions, the purchaser may terminate the contract in the cases provided for in this chapter.
The deliberative assembly of the local authority or the deliberative body of the local public institution authorises the executive body to sign the partnership contract.
All deferred payments are prohibited in contracts awarded by the State, its public establishments, local authorities, their public establishments and their groupings.
The threshold above which contracts must be concluded in writing is set at €25,000 excluding tax.
Where the contract refers to general documents, it shall include, where appropriate, an indication of the articles of these documents from which it derogates.
Contracts concluded by contracting authorities with a public accounting officer shall specify the administrative and technical conditions to which authorisation and payment are subject.
The minimum time limit for receipt of applications and tenders is thirty-five days from the date of dispatch of the contract notice.
The purchaser shall set the time limits for receipt of tenders, taking into account the complexity of the contract and the time needed by economic operators to prepare their tenders.
In particular, the purchaser may require economic operators to achieve a minimum annual turnover, particularly in the field covered by the contract.
