Title I

ESTABLISHMENT OF ELECTORAL ROLLS

I-1. The Director of the Ecole Nationale de Voile et des Sports Nautiques shall draw up the list of voters and eligible persons for each college in accordance with the provisions of this appendix and of articles A. 211-39 to A. 211-42.

I-2. The Director shall publicise these lists, in particular by posting them. Any complaint must be sent to the Director by registered letter with acknowledgement of receipt, within eight days of the date of publication. The Director shall decide whether the complaints are well-founded and shall draw up the final electoral roll within the same period.

Title II

ORGANISATION OF VOTING OPERATIONS

II-1. Timetable for the voting process

The timetable for the voting operations is set as follows:

posting and publication of the electoral lists at least thirty days before the date of the ballot;

-deposit of nomination papers at least twenty-one days before the date of the ballot;

-distribution of voting material within the establishment at least fifteen days before the date of the ballot;

-counting of all ballot papers on the day of the ballot;

-declaration of the results on polling day itself.

II-2 a. Material organisation

Nomination papers, specifying the names of the full and alternate candidates, shall be sent by registered letter with acknowledgement of receipt, or lodged with the Director against receipt.

Each nomination must include both a full member and an alternate member.

Candidates may submit a profession of faith with their nomination.

II-2 b. Voting materials

The Ecole Nationale de Voile et des Sports Nautiques is responsible for producing the ballot papers and envelopes, which must be of a single model.

The school will send the voters, in good time, in envelopes bearing their name:

ballot papers;

-a copy of this appendix;

-where applicable, the candidates' professions of faith.

In the case of persons absent from the school during this period, for whatever reason, a letter with acknowledgement of receipt will be sent to the elector's home address, at least seven days before the closing date of the ballot.

II-2 c. Polling station

Electors must use only the voting materials provided by the school.

The vote, on pain of nullity, must be cast using a single ballot paper bearing no erasures, distinctive marks or overwriting. This ballot paper shall be placed by the voter in an envelope which must also bear no identifying mark.

On-site voting shall take place at the Ecole Nationale de Voile et des Sports Nautiques on polling day.

Postal voting shall be permitted for all voters. All postal votes shall be sent to the post office box opened for this purpose at the school's head office.

Postal votes shall be collected en bloc from the post office at the school's head office, the day before the date set for voting on the spot.

For votes sent by post, the outer envelope (envelope no. 1), bearing pre-stamped postage, must not contain any words other than those pre-printed. A second envelope (envelope no. 2), into which a third envelope (envelope no. 3) containing the ballot paper is slipped, must show, legibly written: the surname, first name, college to which it belongs and the voter's signature.

Voters who are unable to vote in person may exercise their right to vote through a proxy, by giving him or her written power of attorney to vote in their place.

The proxy must be entered on the same electoral roll as the principal. No person may hold more than two proxies.

Voting shall take place in public in an easily accessible room where the freedom and secrecy of the vote are guaranteed, under the supervision of a polling station consisting of a chairman and two assessors chosen by the director from among the electors.

The ballot papers and envelopes shall be placed on a separate table from that on which the ballot box is placed.

Voters must pass through a polling booth.

Voters shall be asked to sign a list of voters before the ballot paper is placed in the ballot box. Voters must be able to provide proof of their identity.

Before voting begins, postal votes are counted.

The names of the voters from whom the envelopes originate are entered on the lists.

The following shall be set aside unopened

-envelopes no. 2 which are unsigned or do not show the surname, first name and college of the voter or on which these details are illegible ;

-envelopes no. 3 or ballot papers found in envelope no. 1 without envelope no. 2.

The elector's vote shall be null and void:

multiple No. 2 envelopes received under the signature of the same elector;

-No. 3 envelopes bearing a distinctive word or sign;

-multiple No. 3 envelopes received in the same No. 2 envelope;

-ballot papers found in envelope no. 2 without envelope no. 3.

The envelope containing the ballot paper shall be placed in the ballot box.

Title III

RESULTS

III-1. Counting of votes

The counting of votes takes place in public at the polling station.

The chairman of the polling station ensures that there are enough scrutineers to count the votes. The number of scrutineers must be at least equal to the number of persons making up the polling station.

At the close of the ballot, the polling station checks that the number of envelopes collected in the ballot box is equal to the number of votes cast on the voters' list.

Each member of the polling station signs the voters' list.

The votes are counted immediately afterwards.

The following in particular are deemed to be invalid

empty envelopes;

- ballot papers found in the ballot box without an envelope;

- ballot papers or envelopes that do not conform to the standard model;

- ballot papers or envelopes bearing a distinctive sign, overwriting or erasures;

-different ballot papers contained in the same envelope.

In the event of a tie in the number of votes obtained, the oldest candidate shall be elected.

The final results shall be announced by the president of the polling station and recorded in a summary report of the vote signed by the president and the assessors. Invalid ballot papers and unopened envelopes shall be appended to the minutes.

The minutes shall state:

1. The number of registered voters;

2. The number of voters who voted;

3. The number of blank or invalid ballot papers;

4. The number of votes cast;

5. The number of votes received by each candidate;

6. The difficulties and incidents that have arisen.

A copy of these minutes will be posted by the Director of the Ecole Nationale de Voile et des Sports Nautiques.

III-2. Disputes

Any disputes regarding the validity of the electoral process shall be referred to the Director of the Ecole Nationale de Voile et des Sports Nautiques within five days of the announcement of the results.

The Director must give a ruling within eight days, at the end of which time the request is deemed to have been rejected.
